Partner Neil Mascolo Obtains Summary Judgment in a Fire Damage Subrogation Case

In a recent decision from Supreme Court, Nassau County, partner Neil Mascolo obtained summary judgment in favor of our client, an electrical contractor.  The case involved five causes of action resulting from a fire in Roslyn, NY.  In granting summary judgment  in favor or our client, the court agreed with our argument that our client’s work did not cause or contribute to the fire, moreover, that there was no evidence to refute the findings of the Fire Marshall, who found that an extension cord, which was unrelated to our clients work, was the cause of the fire. The court also relied on the findings of our expert who opined that there was no negligence on the part of the electrical contractor. Interestingly, the court found questions of fact with regard to work of the general contractor and denied their motion.
